TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your use of the ELYSORA Jewelry website and your purchase of products from ELYSORA Jewelry (“ELYSORA,” “we,” “us,” or “our”).

By accessing our website, placing an order, or submitting personalization materials, you agree to these Terms and acknowledge our Privacy Policy, Shipping Policy, and Returns & Exchanges Policy.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order.  If you submit personalization materials belonging to a minor or another person, you represent that you are legally authorized to provide and direct the use of those materials.

2. Personalized and Made-to-Order Products

ELYSORA jewelry is personalized and made to order based on the selections, instructions, and materials submitted by the customer.  Product photographs are provided for reference. Slight variations in color, appearance, dimensions, finish, natural materials, stones, and personalization placement may occur because of differences in screens, materials, and handcrafted production. Ordinary variations are not considered defects.

3. Personalization Materials

Personalization materials may include photographs, fingerprint images, handwriting, signatures, names, initials, dates, messages, and other customer-submitted content.  You are responsible for reviewing all personalization selections, spelling, dates, images, and instructions before submitting them. ELYSORA is not responsible for errors contained in materials or instructions submitted by the customer.

By texting, uploading, or otherwise submitting personalization materials to ELYSORA, you:

• Confirm that you have the legal right, permission, and authority to provide and use the materials.
• Confirm that the materials do not infringe another person’s privacy, intellectual-property, publicity, or other legal rights.
• Expressly authorize ELYSORA and its authorized service providers to receive, use, reproduce, crop, resize, clean, format, and otherwise prepare the materials solely as reasonably necessary to design, manufacture, fulfill, service, repair, replace, or remake the personalized jewelry you requested.

This authorization is limited to fulfilling and supporting your order and does not transfer ownership of your personalization materials to ELYSORA.

You may not submit unlawful, infringing, abusive, hateful, deceptive, or otherwise inappropriate content. ELYSORA may decline or cancel an order containing prohibited materials.

4. Fingerprint Artwork Images

ELYSORA receives and uses customer-submitted fingerprint images solely as personalization artwork and only as reasonably necessary to design, manufacture, fulfill, service, repair, replace, or remake the personalized jewelry requested by the customer.

ELYSORA does not use fingerprint images to identify or authenticate any individual, compare fingerprints, or create biometric identification profiles, biometric templates, or searchable biometric databases.

By texting, uploading, or otherwise submitting a fingerprint image, you confirm that you have the right and authority to provide the image and expressly authorize ELYSORA to use it for the limited order-related purposes described in these Terms and our Privacy Policy.

Fingerprint artwork images are retained and deleted as described in our Privacy Policy.

5. Text and Electronic Communications

When you provide a telephone number or communicate with ELYSORA by text, you authorize ELYSORA to send transactional messages concerning your order, including personalization instructions, requests for clarification, production updates, shipping information, and customer-service communications.

Message and data rates may apply. Consent to receive transactional communications does not constitute consent to receive marketing text messages.

Electronic records—including submitted images, instructions, confirmations, and text-message communications—may be maintained as part of the order record.

6. Orders and Acceptance

All orders are subject to acceptance, product availability, and receipt of complete and usable personalization materials.

We reserve the right to refuse or cancel an order because of:

• Pricing or product-information errors.
• Unavailable materials.
• Incomplete, unclear, or unusable personalization materials.
• Suspected fraud or unauthorized activity.
• Content that violates these Terms.
• Other reasonable production or legal concerns.

If we cancel an order after payment has been processed, we will refund the amount charged for the cancelled item to the original payment method.

7. Prices, Taxes, and Payment

Prices are displayed in U.S. dollars and do not include applicable sales tax unless otherwise stated.

Payment is processed through third-party payment providers. You represent that you are authorized to use the payment method submitted with your order.

We may correct inadvertent pricing, product-description, or promotional errors. If a correction materially affects an order that has already been placed, we will provide notice and, where appropriate, the opportunity to cancel.

8. Production

Personalized orders are generally produced within one to two business days after ELYSORA receives all complete and usable personalization materials.

Production does not begin until any questions concerning the submitted materials or instructions have been resolved. Production estimates are not guarantees and may be affected by product availability, order volume, holidays, or circumstances outside our reasonable control.

9. Shipping and Delivery

Complimentary second day shipping is included in all orders.  Customers are responsible for providing a complete and accurate shipping address. We cannot guarantee an address change after an order enters production or shipment. Delivery dates are estimates and may be affected by carrier delays, weather, holidays, service interruptions, or other circumstances outside our reasonable control. 10. Returns, Repairs, and Replacements

Because ELYSORA jewelry is personalized and made to order, returns and exchanges are limited.

An unworn item in its original packaging may be eligible for repair, remake, replacement, exchange, or refund if it has a manufacturing defect or ELYSORA made an error in producing the personalization, provided the issue is reported within 30 days after delivery.

We generally cannot accept returns or exchanges because of:

• Customer-submitted spelling, date, image, fingerprint, handwriting, or instruction errors.
• A change of mind.
• Ordinary handcrafted or natural-material variations.
• Normal wear.
• Accidental damage, misuse, improper care, or unauthorized repair or alteration.

Nothing in these Terms limits any right or remedy that cannot legally be waived.

11. Jewelry Care

Store jewelry in its pouch and keep it away from harsh chemicals, cleaning agents, perfumes, lotions, and excessive moisture. Clean jewelry with a clean, soft cloth. Normal wear, scratches, finish changes, accidental damage, improper care, and damage caused by pulling or misuse are not manufacturing defects.

12. Website Content and Intellectual Property

The ELYSORA website and its content—including the ELYSORA name, product designs, photographs, graphics, text, logos, and website presentation—are owned by or licensed to ELYSORA and protected by applicable intellectual-property laws. You may use the website only for personal, noncommercial purposes. You may not copy, reproduce, modify, distribute, sell, scrape, publish, or commercially exploit our content without prior written permission.

13. Prohibited Uses

You may not:

• Interfere with the operation or security of the website.
• Attempt to gain unauthorized access to any system or account.
• Introduce malicious code or harmful technology.
• Engage in fraud or impersonate another person.
• Violate another person’s rights.
• Use the website or our products for an unlawful purpose.

14. Third-Party Services

Our website may use services provided by third parties, including ecommerce platforms, payment processors, communications providers, and shipping carriers.

Those services may be subject to separate terms and privacy policies. ELYSORA is not responsible for the independent content or practices of third-party websites or services.

15. Disclaimer

To the fullest extent permitted by law, the website is provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free, or completely secure. Any product warranty is limited to the warranty expressly provided by ELYSORA or required under applicable law.

16. Limitation of Liability

To the fullest extent permitted by law, ELYSORA will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from your use of the website or purchase of our products.  To the fullest extent permitted by law, ELYSORA’s total liability relating to a product will not exceed the amount you paid for that product.

These limitations do not apply where prohibited by law.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any legal proceeding concerning these Terms or a purchase from ELYSORA shall be brought in a court of competent jurisdiction in Los Angeles County, California, unless applicable consumer law provides otherwise.

18. Changes to These Terms

We may update these Terms periodically. Changes become effective when the revised Terms are posted with a new effective date. The Terms in effect when your order is placed will generally govern that order unless a change is required by law.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
